Terms and Conditions

Welcome to The Giant Maker! These Terms and Conditions (“Terms”) govern your use of The Giant Maker’s platform (“Platform”) provided by The Giant Maker (“we,” “us,” or “our”). By creating a Platform Account and using our Platform, you agree to these Terms. Please read them carefully.

1. Use of Platform

1.1. Age Restrictions You must be at least 18 years old to use the Platform. 1.2. Platform Account Ownership You are the owner of the Platform Account unless you are acting on behalf of a business entity, in which case the business entity is the owner. 1.3. Intended Use You can only use the Platform for lawful purposes and in accordance with these Terms. Prohibited Uses include engaging in any activity that violates applicable laws or regulations, exploiting or harming others, and sending unlawful or spam communication. 1.4. Privacy Your use of the Platform is subject to our Privacy Policy. You must also implement and enforce your own Privacy Policy when providing access to the Platform to your customers. 1.5. Login Credentials You are responsible for maintaining the confidentiality of your Login Credentials and must notify us of any unauthorized access to your Platform Account. 1.6. Use of Communication Services You are responsible for complying with laws such as the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act when using communication services on the Platform. The Giant Maker is not responsible for your compliance with these laws.

2. Prohibited Uses

You are prohibited from using the software for illegal, violent, or adult entertainment purposes. You are also prohibited from engaging in email and SMS spam or violating any laws related to email and SMS communication.

3. Payment

3.1. Fees You are responsible for paying the fees associated with the Platform, and the fees are nonrefundable. 3.2. Noncancellable Fees Some subscriptions may have minimum commitment requirements that cannot be canceled until the commitment is fulfilled.

4. Affiliate Program

You may participate in our Affiliate Program to earn commissions by referring new accounts to The Giant Maker. Please review the Affiliate Program terms for specific details.

5. Intellectual Property

5.1. Platform Content You acknowledge that the Platform and Platform Content are the property of The Giant Maker or its licensors. You are granted a personal, non-exclusive license to access and use the Platform Content for its intended purpose on the Platform. 5.2. The Giant Maker Marks You are prohibited from using The Giant Maker Marks without permission and from misrepresenting any association with The Giant Maker. 5.3. User Contributions You own the content you post on the Platform but grant The Giant Maker a perpetual license to use and disclose your User Contributions. You are responsible for the legality and appropriateness of your User Contributions. 5.4. Prohibited User Contributions You are prohibited from posting User Contributions that are unlawful, threatening, abusive, or infringe any intellectual property rights.

6. Disclaimer of Warranties

The Giant Maker provides the Platform on an “as is” and “as available” basis. We do not make any warranties, whether express or implied, regarding the Platform, including but not limited to the accuracy, reliability, or suitability for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, The Giant Maker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold The Giant Maker, its affiliates, and their respective officers, directors, employees, and agents, harmless from and against any claims, liabilities, or damages (including legal fees) arising out of or in connection with your use of the Platform, your User Contributions, or your violation of these Terms.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at any time without prior notice, for any reason or no reason, including but not limited to a violation of these Terms or applicable laws or regulations.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws provisions.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12. Changes to the Terms

13. Entire Agreement
